Cancellation, Reschedule & Refund Policy

Version 1.4.1 – Effective 6 Oct 2025 (Australia-wide)

1. Definitions

WorkshopAny paid photography workshop, tour, retreat or tuition advertised by us.
Client / Participant / youThe individual or entity who books and pays for a Workshop.
Start Date00:01 local time on Day 1 of the scheduled Workshop.
Force Majeure EventAn event beyond a party’s reasonable control (e.g. natural disaster, pandemic, government restriction, serious illness or injury of the workshop leader).

2. Booking & Payments

  1. Deposit – A 30 % non-refundable deposit secures your place.
  2. Balance Due – The remaining 70 % is payable between 30 and 60 days before the Start Date (as stated on your invoice).
  3. Late Bookings (within 30 days) – 100 % of the fee is payable at the time of booking.
  4. Non-payment – If full payment is not received by the due date, we may cancel your booking, retain your deposit, and offer the seat to another participant.
  5. GST – All prices include Australian GST where applicable.

3. Cancellation by Client

*Refunds are processed within 10 business days to the original payment method.

How to cancel – send written notice to info@dylanknight.com.au. The effective date of cancellation is when the email is received.

Goodwill Clause (optional): If we successfully re-sell your seat, we may, at our discretion, issue a credit for future use instead of enforcing forfeiture.

4. Reschedule & Transfer

  1. One-time transfer of your booking to another Workshop or date is permitted if requested 30 days or more before the Start Date and the balance has been fully paid, subject to availability.
  2. Transfers requested within 30 days are treated as cancellations unless your seat is re-sold, in which case we may, at our discretion, apply your payment as credit less A$100 admin fee.

5. Cancellation or Material Change by Us

  1. Minimum Numbers – We may cancel if fewer than 2 participants are confirmed 30 days prior. You may choose a full refund or fee-free transfer.
  2. Force Majeure – If a Force Majeure Event requires cancellation or date change, you may elect to:
    • transfer to a new date,
    • receive a credit valid for 24 months, or
    • receive a full refund. Our liability is strictly limited to monies paid.

6. Client Responsibilities & Insurance

You are solely responsible for travel, accommodation, equipment, and comprehensive travel insurance covering cancellation, medical, equipment, and weather-related disruptions from the date of deposit payment.

7. Liability & Risk Acknowledgement

  1. Outdoor photography involves inherent risks including but not limited to uneven terrain, wildlife, and weather. Participation is voluntary and at your own risk.
  2. We accept no liability for loss, injury, or damage except as required under the Australian Consumer Law.
  3. Nothing in this Policy limits or excludes any rights you have under the Competition and Consumer Act 2010 (Cth) or applicable State/Territory fair-trading legislation.

8. Dispute Resolution

Please notify us in writing of any dispute and allow 14 days for response. If unresolved, either party may refer the matter to the Civil & Administrative Tribunal of the State or Territory where the Workshop was delivered (e.g. QCAT, NCAT, VCAT, SAT, TASCAT) or to another agreed mediator before commencing court proceedings.

9. Amendments

We may amend this Policy by posting an updated version on our website. The version in force on the date your deposit is paid applies to your booking.

10. Partner & Affiliate Benefits

As an authorised reseller and educator (e.g. Nikon Australia), we occasionally offer exclusive partner discounts or benefits. These promotions do not alter the terms of this Policy or your refund entitlements.

11. Governing Law

This Policy is governed by the laws of the State or Territory in which the relevant Workshop is conducted. Each party submits to the non-exclusive jurisdiction of the courts of that State or Territory.

Dylan Knight Photography maintains comprehensive public liability insurance up to A$20 million, ensuring appropriate coverage for all approved workshops and activities.
